Federal Court Mandates Freedom of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.
The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
